Agreement to these terms

By using this website or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the site.

These terms apply alongside our Privacy Policy and our Shipping & Returns policy, both of which form part of this agreement.

Using this site

You may use this site for lawful, personal purposes. You must be at least 18 years old to place an order, or have the permission of a parent or guardian who accepts these terms on your behalf.

We may change, suspend, or discontinue any part of the site at any time without notice.

Accounts

If you create an account, you are responsible for keeping your password secure and for everything that happens under your account. Tell us promptly if you believe someone else has accessed it.

We may suspend or close an account that we reasonably believe has been used to break these terms.

Products and pricing

We try to describe and photograph our products accurately, but colors and details can appear differently on different screens, and we do not warrant that every description is complete or error-free.

Prices are in US dollars and may change without notice. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full rather than honor the mistake.

Products are subject to availability and we may limit quantities.

Orders and payment

Your order is an offer to buy. We accept it when we send you a confirmation email. Until then, we may decline or cancel any order for any reason, including suspected fraud or a pricing error.

Payments are processed by Stripe and PayPal. By ordering, you confirm you are authorized to use the payment method you provide.

You are responsible for any sales tax that applies to your order, which is calculated at checkout.

Shipping and returns

All sales are final. We do not accept returns, exchanges, or cancellations once an order has been placed.

Our intellectual property

Everything on this site — our videos, animations, stories, artwork, logos, product designs, and written content — belongs to Kindness Studios or our licensors, and is protected by copyright and trademark law.

You may view and share our content for personal, non-commercial purposes. You may not copy, reproduce, sell, or create derivative works from it without our written permission.

The Kindness Studios name and logo may not be used without our permission.

Content you submit

If you send us photos, videos, reviews, comments, or other material, it stays yours. You are not transferring ownership to us.

You do give us permission to use, display, reproduce, adapt, and distribute that material in connection with Kindness Studios and its mission, including on our website and social media, without payment to you.

By submitting content, you confirm that it is yours to share, that it does not infringe anyone else’s rights, and that anyone identifiable in it has agreed to appear.

We may remove submitted content at any time, for any reason.

Kindness Ambassadors

Kindness Ambassadors help spread our message and are compensated for doing so. Participation is subject to any separate agreement we have with you, which takes precedence over this section where the two differ.

Ambassadors must represent Kindness Studios honestly, must disclose their relationship with us when required by law, and must not make claims about our products or mission that we have not authorized.

We may end an ambassador relationship at any time.

Things you may not do

• Use the site for any unlawful purpose
• Harass, bully, threaten, or abuse anyone through the site — this one matters to us more than most
• Impersonate another person or misrepresent your affiliation with us
• Attempt to gain unauthorized access to the site, other accounts, or our systems
• Introduce viruses or any other malicious code
• Scrape, harvest, or collect data from the site by automated means
• Resell our products commercially without our written permission

Third-party links

Our site links to other websites, including social media platforms and the organizations we support. We do not control those sites and are not responsible for their content, their products, or their privacy practices.

Disclaimers

This site and our products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted, secure, or error-free.

Nothing here limits any rights you have under consumer protection laws that cannot be waived.

Limitation of liability

To the fullest extent permitted by law, Kindness Studios is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this site or our products.

Where liability cannot be excluded, our total liability to you is limited to the amount you paid us for the order giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Kindness Studios and its owners, employees, and partners from any claims, losses, or expenses arising out of your breach of these terms, your misuse of the site, or content you submit.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of law rules.

Any dispute will be brought in the state or federal courts located in Orange County, California, and you agree to that jurisdiction.

If any part of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the date at the top of this page. Continuing to use the site after a change means you accept the updated terms.
